Parents across Oxfordshire are raising the alarm over a systemic failure impacting some of the most vulnerable pupils in the education system. The issue centers on Education, Health and Care Plans (EHCPs), the legal documents outlining support for children with special needs.
While the educational provisions within an EHCP can be appealed through a tribunal, the critical health components cannot be legally challenged in the same way. This has left numerous children with complex medical conditions effectively stranded in classrooms without the necessary nursing or therapeutic care stipulated in their plans.
Families report that without a legal mechanism to enforce the health side of the agreement, local health authorities and schools are often at an impasse. The result is pupils missing school entirely or attending without the vital support they require to participate safely and effectively. Parents describe an exhausting cycle of negotiations with no power to compel action, leaving their children's well-being and education in jeopardy.
Campaigners are now calling for urgent reform to close this legal loophole. They argue that severing health from education in the appeals process renders the entire EHCP framework ineffective for many, contradicting its purpose of providing holistic, legally binding support. The situation underscores a broader crisis in provision for children with special educational needs and disabilities.
